I Mary Rhodes of Albemarle County &amp; State of Virginia being in delicate bodily health, but in an usual state of mind, memory, judgment and understanding, do make this my last will and testament, in manner &amp; form following, viz:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1<sup>st<\/sup>&nbsp;After my just debts shall have been paid, I will that all of my property and estate of every sort, kind and character, shall be equally divided between Willis M. White, Mary M. White, and Nancy D. White, subject to the following conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2<sup>nd<\/sup>, I will and wish that all my estate shall be divided or not, at my death, as the distributees may chose, but be kept together for their mutual benefit as long as they live together, an be under the management of Willis M. White for their collective use or support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3<sup>rd<\/sup>, I will that if either one, or all, shall separate from each other, then &amp; at such time, he, she or they may take his, her, or their proportion of my estate and dispose of it, as he, she, or they choose. And also each one (named above) is hereby authorized to will his or her proportion at his or her death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lastly, I constitute and appoint Willis M. White (named above) Executor to this my last will &amp; testament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Given under my hand &amp; seal this 30<sup>th<\/sup>&nbsp;day of January 1850.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mary X Rhodes (seal)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Signed, sealed &amp; acknowledged<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">in the presence of<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">E. J. Thompson<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">B.B. Thompson<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">James E. Chapman<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Albemarle County Court October 7 1861<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The last will and testament of Mary Rhodes deceased, was partly proved by the oath of E. J. Thompson and continued for further proof.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And in the same Court on the 4<sup>th<\/sup>&nbsp;November 1861<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The last will and testament of Mary Rhodes dec&#8217;d was fully proved by the oath of B. B.
